Directive 2014/28/EU of the European Parliament and of the Counsel of 26 February 2014 on the harmonisation of the laws of the Member States relating to the making available on the market and supervision of explosives for civil uses (recast)

Scope

This Directive shall apply to explosives for civil uses. It shall not apply to: explosives, including ammunition, intended for use, in accordance with national law, by the armed forces or the police; pyrotechnic articles falling within the scope of Directive 2013/29/EU; or ammunition, save as provided for in Articles 12, 13 and 14 of this Directive. (Art. 1) For the purposes of this Directive, 'explosives' means the materials and articles considered to be explosives in the United Nations recommendations on the transport of dangerous goods and falling within Class 1 of those recommendations; and 'ammunition' means projectiles with or without propelling charges and blank ammunition used in portable firearms, other guns and artillery. (Art. 2)

The economic operators, as defined in this Directive - i.e., manufacturers, importers, distributors and authorised representatives - are required to fulfil the obligations detailed in Chapter 2 (Articles 5-10) in order to place explosives on the market or use them for one's own purposes in compliance with this Directive. Other important areas of regulation of explosives for civil uses defined in this Directive: Articles 11 & 12 - Transfer of explosives and transfer of ammunition Article 15 - Identification and traceability of explosives Articles 16 & 17 - Licence or authorisation, licencing of manufacturing activities Chapter 4 (Articles 19-23) - Conformity of the explosive, including CE marking
