Justification for classification or non-classification

Depending on the batch, the proportion of some of the impurities as 3 -chloropropene and ethyl chloride may vary. Some of the samples contains up to 0.5% in 3-chloropropene while other contains up to 5% of the same substance. In the same manneer, some of the samples contains up to 0.8% in ethyl chloride while other contains up to 1% of the same substance. As the percentage of these two substances is in any case above 1%, we should classified the reaction mass containing mainly 2-chloropropene as

-Carc. Cat. 3/R40 (limited evidence of carcinogenic effect) according to the mixture's criterias of DSD legilslation

-Carcinogenicity Cat. 2/H351 (Suspected of causing cancer) according to the mixtures's criterias of CLP legislation.

Additional information

No information is available on the carcinogenicity for the reaction mass containing mainly the 2-chloropropene. However, as the 3-chloropropene and the ethyl chloride which are two substances constituting the mixture are both officially classified as Carcinogen Cat. 2/H351 (Suspected of causing cancer) according to CLP legislation, it was taken into account to propose the classification.
