Justification for classification or non-classification

According to the CLP Regulation (EC 1272/2008), the threshold of classification of a substance for acute aquatic toxicity is 1 mg/l. This limit is compared with LC50 (96h) for fish, EC50 (48 h) for crustacea and EC50 (72 - 96 h) for algae.

Moreover, in case of lack of chronic data, the potential for chronic toxicity is identified by appropriate combinations of acute toxicity data and lack of biodegradability. The threshold of classification for chronic toxicity is 100 mg/l.

A safety net classication, in category chronic 4, applies when data do not allow classification under the above criteria but there are however some grounds for concern. This is the case for poorly soluble substances, for which no acute toxicity is recorded at levels up to the water solubility , which are not rapidly degradable and have an experimentally determined BCF ≥ 500, indicating a potential to bioaccumulate.

An experimental BCF value of the substance was not available; however, a prediction made by BCFBAF v3.10 as implented in EPI Suite was considered as reliable. Consequently, based on the low water solubility, the lack of toxic effects up to solubility limit in fish, crustacea and algae, and an estimated BCF of ca. 5300 l/kg wet weight, a classification in category chronic 4 (H413) was applied.
