JUSTIFICATION FOR DATA WAIVING
Conclusion based on structure analogy: The target substance, pitch, coal tar, high-temp., <1% 4- to 5-membered condensed ring aromatic hydrocarbons [EC no. 701-305-8] (CTPhtht), is directly derived from pitch, coal tar, high temp. [CAS no. 65996-93-2] (CTPht) by additional distillation processing. Hence, both complex substances still share similar structure and similar phys.-chem. properties; but thanks to the decrease in the fraction of lower PAHs and the concomitant increase in degree of condensation of ring-structures in CTPhtht, its bioavailability is further reduced as compared with the precursor. Furthermore, neither substance exhibited noticeable short-term aquatic toxicity (EL/LL50 > 100 mg/L), while there was no evidence of long-term aquatic toxicity for the precursor, CTPht, hence either to be supposed for the target compound.
