JUSTIFICATION FOR DATA WAIVING
In accordance with column 2 of REACH Annex IX, information requirement 9.3.2 (bioaccumulation in aquatic species, preferably fish), a study does not need to be conducted if the substance has a low potential for bioaccumulation (for instance a log Kow ≤ 3) and/or a low potential to cross biological membranes. The Log Kow of the hydrolysis product, 4,4'-Bisphenol Tetra-Acid (BPA-TA; CAS 38103-05-8) of the registered substance is -2.2 and it is considered justified to omit this study.

Description of key information

The test material is unstable in water due to hydrolysis; therefore a test conducted with the hydrolysis product 4,4'-Bisphenol A Tetra-Acid (BPA-TA, CAS # 38103-05-8) would potentially be more appropriate. However, in accordance with section 9.3.2 of Column 2 of REACH Annex IX, the study does not need to be performed if the substance has a low potential for bioaccumulation (for instance, if it has a log Kow ≤ 3) and/or a low potential to cross biological membranes. The partition coefficient of BPA-TA is lower than 3 (Log Pow 0.7 at pH 5, <-2.22 at pH 7 and <-2.2 at pH 9). It is therefore considered justified to omit this study.
